1. Acceptance of Terms

By accessing and using ClearGauge (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use this site. The Service is intended to provide estimations of river flow conditions based on public data, but it is strictly for informational purposes.

2. Assumption of Risk (IMPORTANT)

Whitewater kayaking, rafting, wading, fishing, and all other outdoor water activities are inherently dangerous activities that can result in serious injury or death.

You acknowledge and agree that you are solely responsible for your own safety when engaging in outdoor recreation. You must always scout rapids, assess hazards personally, and wear appropriate safety equipment, including Coast Guard approved PFDs and helmets. ClearGauge is not a substitute for on-the-ground observation, proper training, or common sense. By using this Service, you expressly assume all risks associated with your recreational activities.

3. No Warranty on Data Accuracy & USGS Disclaimer

ClearGauge utilizes public API data provided by the United States Geological Survey (USGS) via the modernized Water Data for the Nation (WDFN) OGC API, and the National Weather Service (NWS) active alerts API.

Provisional Data: Data retrieved from the USGS is often provisional and subject to significant revision. It may be inaccurate due to sensor malfunctions, ice, debris, or network outages.
NWS Alerts: We programmatically fetch National Weather Service flood watches and warnings based on a gauge's coordinates. However, our system may experience latency, downtime, or filtering errors. You must rely directly on official NOAA weather radios and weather.gov for life-safety warnings, not ClearGauge.
No Government Endorsement: ClearGauge is an independent, third-party application. We are not affiliated with, endorsed by, or sponsored by the USGS, NOAA, NWS, or any other government agency.
"As Is" Basis: All data, flow verdicts (e.g., "High", "Normal", "Low"), and analytics are provided strictly on an "as is" and "as available" basis without any warranties of any kind.

4. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will ClearGauge, its developers, owners, affiliates, or data providers (including the USGS) be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, personal injury, wrongful death, property damage, or lost profits arising out of your access to, use of, or inability to use the Service.

5. Indemnification

You agree to defend, indemnify, and hold harmless ClearGauge and its operators from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Service or your use of the Service, including, but not limited to, any injuries or damages sustained while using information obtained from the Service.

6. User-Submitted Content

By submitting a condition report, you grant us a non-exclusive, royalty-free, perpetual license to display, modify, and distribute that content on this site. You represent that your submission is accurate to the best of your knowledge and does not contain harmful, spam, or misleading content. We reserve the right to remove or alter reports at our sole discretion.

7. Governing Law

These Terms of Service and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of India, without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding shall be instituted exclusively in the courts of India.
